Photographer
The photographer shall be the exclusive photographer retained by the client for photographing the event.
Client
The “Client” means the party identified as Client in this agreement to which these terms and conditions are applying to, or any party subsequently appointed as a replacement of the Client.
Deposit and Payment
The Client shall make a deposit of 30% of the Total Due to retain the Photographer to perform the services specified herein. On the date of the event the remaining 70% is due.
Option to Cancel Services
The Client shall have the right to cancel. If the client shall cancel this agreement 45 or more days before the event, the deposit will be refunded in full. If the client shall cancel within 45 days prior to the event 50% of the deposit will be retained.
Failure to Perform
If the photographer is unable to complete photography of the event, due to illness, fire, or any cause beyond the control of the photographer, the deposit will be refunded in full and the photographer will have no further liability with respect to this agreement.
Substitute Photographer
In the event of any of the above listed situations, the photographer may substitute another photographer. In the event of a substitution, the substitute photographer shall be competent and professional.
Pricing
The prices in this agreement are based on Snickerdoodle Photography Price List. This price list is adjusted annually and future orders and assignments shall be charged at the prices in effect at the time when the order is placed. GST will be charged.
Photographic Materials
All photographic materials, including but not limited to digital files, prints or proofs, shall be the exclusive property of the photographer.
Copyright & Reproductions
The photographer shall own the copyright to all images created and shall have the exclusive right to make reproductions for a portfolio, samples for promotions, advertisements, entry into contests, exhibitions, editorial use, the Snickerdoodle Photography website or acting in its sole an absolute discretion, any other use. The Client hereby releases the photographer and Snickerdoodle Photography from any and all liability arising therefrom.
The Client will receive their photographs on CD/DVD - unless otherwise agreed - and have permission to make an unlimited number of copies and prints/products of the images, or to reproduce the images solely for personal use.
Turnaround Times
Photographs will be delivered to client via CD/DVD and available for purchase online within 6 weeks of the event (or less whenever possible) unless Client has made special requests (such as extensive retouching to images). Online purchasing gallery will be available for 3 months from the date it is uploaded. Wedding albums require 3-8 weeks for delivery, depending on Client's album selection, from the date of order.
